Terms & Conditions
1. Acceptance of Terms
These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and ShopperTell ("we", "us", "our") governing your access to and use of the ShopperTell mobile application and any related services (collectively, the "Service").
If you do not agree to these Terms, do not download, install, or use the Service.
2. Eligibility
You must be at least 13 years of age to use ShopperTell. By using the Service, you represent and warrant that:
- You are at least 13 years old (or the minimum age required in your country).
- You have the legal capacity to enter into a binding agreement.
- You will use the Service in compliance with all applicable laws and regulations.
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and account.
- Notify us immediately of any unauthorized access to your account.
- Be responsible for all activity that occurs under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines.
4. User Content
ShopperTell allows users to post shopping reviews, stories, tips, and other content ("User Content"). You retain ownership of your User Content, but by posting it you grant ShopperTell a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute, and adapt your content in connection with operating and improving the Service.
You agree that your User Content will not:
- Be false, misleading, defamatory, or fraudulent.
- Infringe any third-party intellectual property rights.
- Contain spam, malware, or unauthorized advertising.
- Harass, threaten, or abuse other users.
- Violate any applicable law or regulation.
We reserve the right, but have no obligation, to remove any User Content that violates these Terms or that we find objectionable in our sole discretion.
5. Community Guidelines
ShopperTell is built on authentic shopping experiences. Users are expected to:
- Post honest, first-hand reviews and experiences.
- Respect other community members.
- Not impersonate brands, retailers, or other users.
- Not engage in coordinated inauthentic behavior or review manipulation.
6. Intellectual Property
The ShopperTell name, logo, brand assets, app design, and all proprietary features are owned by ShopperTell and protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service or its content without our prior written consent.
7. Third-Party Services
The Service uses third-party platforms including Google Firebase (authentication, database, cloud storage), and Google Analytics for Firebase (usage analytics). Your use of the Service is also subject to the terms and privacy policies of these third-party providers.
ShopperTell is not responsible for the content, accuracy, or practices of third-party websites or services linked from within the app.
8. Purchases and Affiliate Links
ShopperTell may display links to products sold by third-party retailers. We may earn a commission on qualifying purchases made through these links at no additional cost to you. ShopperTell does not endorse any specific product or retailer and is not responsible for the quality, safety, or delivery of products purchased through third parties.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
10. Limitation of Liability
To the maximum extent permitted by applicable law, ShopperTell and its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Upon termination, your right to use the Service will immediately cease.
You may delete your account at any time through the app settings. Upon deletion, we will remove your personal information in accordance with our Privacy Policy.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of competent jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, where appropriate, notify you through the app. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
